Terms for using the website, application, and Plus license

These Terms of Use apply to the NexyBay Home Records website, web application, Starter edition, Home Records Plus license, and related purchase and support services. By using the service, you agree to these terms. If you do not agree, do not use the service.

1. Purpose of the service

NexyBay Home Records is an organizational tool for recording household inventory, documents, warranties, maintenance, contacts, reports, and related information. It is provided for personal household recordkeeping.

2. Starter and Plus editions

Starter permits up to 10 inventory items and may be used without a time limit. Home Records Plus is a one-time digital license that removes the inventory-item limit, subject to browser storage capacity and other technical limitations. Plus is not a subscription and does not provide automatic cloud storage or synchronization.

When Starter reaches its inventory limit, existing records remain available to view, edit, delete, report, export, and back up. Creating or duplicating additional inventory items requires an active Plus license.

3. License use

A Plus license is for the purchaser’s personal household use and may be used reasonably on the purchaser’s household devices. The license may not be resold, publicly shared, published, used as a group license for unrelated households, or used to operate a competing licensing service.

License validation may occur when the key is activated and occasionally afterward. NexyBay may revoke or disable a license associated with a refunded or reversed payment, fraud, unauthorized resale or sharing, abuse of the license service, or a material violation of these terms.

4. Purchases, delivery, and refunds

Prices and any introductory offer are shown before checkout. A Plus license is normally issued after payment is confirmed. Customers are responsible for providing a working billing email and keeping the order confirmation and license email.

Because Starter is available for evaluation and the digital license is delivered immediately, Plus purchases are generally final after delivery. Limited exceptions are described in the Refund Policy, which is incorporated into these terms.

5. User responsibility

You are responsible for the information you enter, its accuracy, whether you have the right to store it, and how you use or share it. You are also responsible for protecting your device, browser profile, backup files, license email, and any password used for an encrypted backup.

You should create current backups and keep at least one copy in a separate protected location. NexyBay is not responsible for records lost because of browser-data removal, profile changes, device failure, forgotten passwords, damaged files, unsupported software, or failure to maintain a usable backup.

6. No automatic cloud storage or synchronization

The application is designed for local browser storage and does not promise automatic cloud storage, household-account recovery, or synchronization between browsers or devices. Opening the application in a different browser, profile, or device may show a separate empty data store.

7. No professional advice or guaranteed proof

The website and application do not provide legal, insurance, financial, tax, appraisal, security, or emergency advice. Reports and values are based on information entered by the user and are not guaranteed proof of ownership, condition, value, coverage, loss, or acceptance by an insurer, government agency, court, lender, buyer, or other organization.

8. Acceptable use

You may not use the website, checkout, license service, support channels, or application to violate law, infringe another person’s rights, distribute malicious code, interfere with the service, attempt unauthorized access, test stolen payment information, overload systems, bypass license controls, or submit abusive, deceptive, or unlawful content.

9. Ownership

You retain ownership of the household information and files you enter or create. NexyBay and its licensors retain rights in the website, application, design, code, branding, documentation, licensing system, and related materials. A Plus purchase grants permission to use the software; it does not transfer ownership of the software or source code.

10. Availability and changes

The website, application, checkout, or license service may be updated, changed, interrupted, or discontinued. Features, compatibility, and documentation may change over time. NexyBay does not guarantee that every browser, device, file, payment method, or older backup will remain compatible indefinitely.

11. Disclaimer of warranties

To the fullest extent permitted by applicable law, the website, application, and license service are provided “as is” and “as available,” without warranties of uninterrupted operation, error-free performance, complete security, fitness for a particular purpose, or preservation of data.

12. Limitation of liability

To the fullest extent permitted by applicable law, NexyBay will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of records, files, profits, opportunities, or use arising from or related to the website, application, payment, or license service. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to every user.

13. Third-party services

Browsers, devices, storage providers, email services, hosting services, WordPress, WooCommerce, payment providers, and file-sharing tools are governed by their own terms and privacy practices. NexyBay is not responsible for third-party services.

14. Changes to these terms

These terms may be updated as the service changes. The effective date will be revised when updated terms are published. Continued use after an update means you accept the revised terms to the extent permitted by law.
